Terms of Service

Before using or signing in to Kintree, please review the following terms
Kintree operates an online service ("Service") enabling individuals and families to create a family profile. Kintree ("we," "our," "us," or "ourselves") owns and manages this Service.
This Agreement, a legally binding document, outlines our policies for acceptable use of the Service, the content on the Kintree website, and your rights, responsibilities, and limitations in using the Service. By engaging with the Service in any manner, you agree to abide by this Agreement, regardless of whether you've logged in. Your use of the Service is permitted only if you comply with all relevant laws and this Agreement. If you disagree with this Agreement, please discontinue using the Service immediately.
We reserve the right to modify this Agreement at any time. Any changes will become effective immediately upon being posted on the Kintree website, accessible at https://kintree.app/pages/terms or elsewhere. Your continued use of the Service after such modifications constitutes your acceptance of the revised Agreement. We encourage you to regularly review this Agreement to stay informed about any alterations.
  1. Using the Service in prohibited regions is not allowed. By using the Service, you affirm and warrant that (a) all information you provide is truthful and accurate, (b) you will uphold the accuracy of this information, (c) you are 14 years of age or older, and (d) your use of the Service complies with all applicable laws and regulations.
  1. This Agreement remains in effect for the duration of your use of the Service. We reserve the right to terminate your access to the Service at any time without prior notice or liability. Even after your access is terminated, this Agreement remains fully effective.
  1. The Service is exclusively intended for personal use by you and your family and may not be utilized for commercial purposes unless explicitly authorized by us. Prohibited activities include illegal or unauthorized use of the Service, such as gathering user information for unsolicited emails. Commercial advertisements and solicitation may be removed without prior notice or liability. Soliciting Credentials or personal information from other users for commercial or unlawful purposes is strictly prohibited.
  1. We do not claim ownership over the text, files, photos, or any other materials ("Content") you post on the Service. After posting Content, you retain full ownership rights and the right to use the Content as permitted by law. By posting Content, you grant us a limited, non-exclusive, fully-paid, royalty-free license to use and reproduce the Content in line with our Data Policies. Additionally, you provide invited family members with a limited, non-exclusive, fully-paid, royalty-free license to view, download, store, publish, archive, and back up this Content for personal purposes.
  1. You represent and warrant that (a) you own the Content you post on the Service or possess the right to grant the aforementioned license, and (b) posting the Content does not infringe upon the privacy rights, copyrights, or any other rights of any individual. Posting copyrighted material or proprietary information belonging to others without prior written consent from the owner is not permitted.   1. You may not add Content to the Service that is illegal, obscene, violent, sexual, hateful, harassing, racist, demeaning, threatening, inciteful, exploitative, defamatory, abusive, libelous, misleading, or otherwise objectionable. We reserve the right to remove such Content at our sole discretion and report it to relevant authorities.
  1. We retain all rights to materials provided by the Service, excluding Content posted by users. These materials are safeguarded by copyright, trademark, patent, trade secret, and other laws. We grant you a limited, revocable license to view these materials solely for personal use while utilizing the Service. Some materials, provided as part of your family information download, may be stored, published, archived, and backed up in accordance with the specified terms and conditions.
  1. We are not obliged to monitor the Content posted on the Service. While we may choose to monitor for inappropriate Content, we assume no responsibility for such Content and are not obligated to modify or remove it. You bear sole responsibility for the Content you post. We make no express or implied warranties regarding the accuracy or reliability of any Content on the Service. Notify us of any problematic material by providing feedback.
  1. You are prohibited from disrupting, interfering with, or imposing an undue burden on any aspect of the Service, its supporting equipment, or associated networks. Accessing the Service by any means other than through standard web browsing of the Kintree website is explicitly forbidden. This restriction includes automated scripts communicating with the Service. We reserve the right to block access to the Service from any IP address, IP address block, Internet Service Provider, individual, organization, or country deemed, at our sole discretion, to be abusing the Service.
  1. Your use of the Service is subject to our Privacy Policy, which is included in this agreement. The Service uses cookies for sign-in and to remember user preferences. You may delete these cookies at any time using the relevant option in your web browser.
  1. We are not responsible for incorrect, inaccurate, or untimely materials provided by the Service, whether due to user actions or the equipment or programming used to deliver the Service. We do not guarantee the accuracy or opinions expressed on any website linked from the Service, regardless of whether the link was posted by a user. We assume no responsibility for third-party advertisements on the Service or for goods or services provided by advertisers.
  1. We are not liable for any errors, omissions, interruptions, deletions, defects, delays, communication failures, theft, unauthorized access, alterations, or any user information or communication. We do not take responsibility for any issues or technical malfunctions affecting telephone networks, computer systems, servers, providers, equipment, software, or email, nor for any injuries, deaths, or damages resulting from the use of the Service in any way. The Service is provided "AS-IS" and "AS AVAILABLE," and we expressly disclaim any warranties. No advice or information obtained from us shall create any warranty not explicitly stated in this Agreement.
  1. Under no circumstances will we be liable to you or any third party for indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits resulting from the use of the Service, even if we were advised of the possibility of such damages. Regardless of the circumstance, our liability to you for any cause will be limited to the amount, if any, paid by you for the Service.
  1. Disputes concerning the Service are governed by the laws of Australia, without regard to conflict of law provisions.
  1. By using the Service, you agree to indemnify and hold Kintree, its subsidiaries, affiliates, and their respective officers, agents, partners, and employees harmless from any loss, liability, claim, or demand, including reasonable attorneys' fees, arising from your violation of this Agreement, any breach of your representations and warranties, or any Content you post that causes us to be liable to another party.
  1. This Agreement becomes effective upon your use of the Service and is further affirmed when signing in. It constitutes the entire agreement between you and us regarding the Service. Our failure to enforce any right or provision of this Agreement shall not be considered a waiver of such right or provision. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is deemed unlawful, void, or unenforceable, that provision is severable and does not affect the validity or enforceability of the remaining provisions.
